General Terms and Conditions

~ Scope of aplication :
These General Terms and Conditions shall apply to all contracts concluded between the company Céline Garnier, entrepreneur individuel, head office located at : 188 rue Siméon Freynet, 38350 Sievoz, France, registered at the RCS from Grenoble, France, under the following number : 832807810, (hereinafter referred to as “Celine Garnier” or “the Seller”) and a consumer or a trader (hereinafter referred to as "the Customer” or the Client), relating to all goods presented in the Seller's online shop : www.celinegarnier-luthier.com.
The company Celine Garnier is not subject to V.A.T., in conformity with article 293B from the CGI (Code Général des Impots).
The inclusion of the Client’s own conditions is herewith objected to, unless other terms have been stipulated and agreed to expressively.
Celine Garnier reserves the right to modify and/or amend the present terms and conditions at any time, in order to conform to any new legislation and/or in order to provide a better user experience for the website celinegarnier-luthier.com. Thereupon, the terms and conditions prevailing will be the terms and conditions effective on the date of the Client’s order.

~Products presentation
The products offered on for sale by Celine Garnier are the products presented on the website www.celinegarnier-luthier.com at the day the website is consulted and within the limits of available stocks. Celine Garnier reserves the right to modify the range of products offered for sale and/or discontinue any product offered for sale, at any time and without notice.
Every product is presented on the website with a corresponding technical description (dimensions, use, materials…) as well as photographies. The photographies illustrating the products are as true and realistic as possible, but they are only indicative in nature and are therefore non-binding. Thereupon, Céline Garnier can not be held responsible for any mistake or inaccuracy within the photographies or the graphic illustrations of the products offered for sale on the website.​

~ Products availability
The products are offered for sale within the limits of available stocks. In the event of a stock shortage, Celine Garnier will contact the Customer by mail or by phone without delay to inform him to inform him of the unavailability of the product or products.

~ Products prices
The prices are indicatedf on the products pages of the internet catalogue and are to be understood as prices in Euros (€) , French taxes included (TTC). Those prices take in account the VAT applicable at the date of the order.

Céline Garnier reserves the right to modify each and any price at any time and without notice. It is however to be understood that the prevailing price will be the price effective and published on the product page at the date of the Client’s order. The prices indicated do not include the shipping and delivery costs, nor the eventual customs duty , nor the optional shipping insurance. Those costs and duty shall be borne only by the Client and will be charged additionally, according to the order’s total cost, total weight and nature.

~ Order and terms of payment
Every order implies the full and complete acceptance of the present General Terms and Conditions.
The mere fact of placing an order implies that the Client renounces to his own buying terms and conditions.
Orders shall be accepted only following the conditions thereafter indicated. The inclusion of the Client’s own conditions is herewith objected to, unless other terms have been stipulated and agreed to expressively in writing, by Celine Garnier.
Before placing an order, the Client has to register and create an account on the website www.celinegarnier-luthier.com. The Client may access his customer account at any time via the “Tools” page​. To consult his customer account page, in order to place an order or to consulte his account information (check on a pre-existing order, personal informations, etc…), the Client will have to enter the informations he provided by signing up.
Celine Garnier invites the Client to order and pay for the products following the steps thereafter described.
The Client selects the products he whishes to order and place them in the “basket”. He is then offered the opportunity to check his order and is given the possibility to modify it (product reference, quantity, etc…). Then the Client is invited to check the delivery address and/or modify it if needed. Then shipping and delivery costs are calculated, as well as eventual tax duties, optional insurance costs, etc…, and the name of the selected shipping company. Those additional costs and duties are presented to the customer for him to validate and accept them. The next stepgives the Client the opportunity to double check all the informations related to the order, to read, understand and expressely accept the present General Terms and Conditions by ticking a specific box, and to invite him to definitely validate his order by clicking on the “confirm my order” button. Finally, the Client is redirected on the WIX PAYMENTS secure payment platform and requested to provide his credit card informations. If the payment is accepted, the order is formaly registered and the contract is definitely concluded. Payment made by credit card are irrevocable. The order shall then be treated by Celine Garnier and shipped without delay (within a maximum of 2 to 4 working days) Celine Garnier retains title of ownership to the delivered goods until the purchase price owed has been paid in full, including shipping and delivery costs, eventual tax duties and/or optional insurance costs.

~Right of Withdrawal
provides the customer with a 14 working days delay
The right of withdrawal as defined in Article L121-20 of the Code de la Consommation (French Code of Consumption) consists in the possibility granted to Customer to decide unilaterally to terminate the contractual relationship with the seller within a delay of 14 working days starting at the date of the reception of the goods ordered, returning the purchased goods (or revoking the order made), and thereby obtain the return of the price paid, without penalty except for the return shipping costs.

However, to exert this right , the client must comply with the following conditions :

. Return shipping costs shall be borne by the Client only.

Celine Garnier reserves the right to refuse a return package and ship it back to the Client if the products are damaged or not packed carefully enough.

~ Shipping and delivery to France (France métropolitaine)
Deliveries are made to the address indicated on the order form, which must be located within the geographical area indicated on the website. Orders are delivered by La Poste (the French Post) via their Colissimo service, delivery service without signature. Céline Garnier can provide the Client a tracking number for his package.
​For international deliveries, local taxes and/or customs duties may be due, in accordance with the laws of the country where the Customer's order is to be delivered. These taxes and/or customs duties are exclusively the responsibility of the customer, and will be collected directly by the company in charge of the shipment. The customer is informed of this fact on the "DELIVERY" tab.
From the moment where the goods leave Celine Garnier's premises on, the Customer shall bare all the risks related to the shipping and delivery. Upon reception of his order, and with the delivery personn still present, the Customer is required to check that the packaging is intact and that the goods ordered are in good condition. This verification must be done every time, even if the package doesn't seem damaged, so as to be able to file a complaint with the delivery company in case of a problem. Only claims or remarks made by the Client himself upon reception may be received by the delivery Company and trigger the warranty of the delivery Company, Celine Garnier cannot intervene.
Shipping costs and delivery time depend on the products selected by the Customer by placing an order.
For items shipped to France (metropolitan area), maximum shipping time is 12 working days, although it is normally much faster (generally only a few days).
For items shipped to Corsica, please allow 1 to 2 additional working days.
Shipping times indicated are an estimation and may vary with the disponibilities of the delivery company. Celine Garnier will do her very best to respect the shipping times indicated, but cannot be held responsible in case of exceptionnal external circumstances, unforeseeable event and in case of force majeure. Leventual delays do not entitle the Client to cancel the order, refuse the package or claim any late fee or indemnity.
Shipping costs are calculated according to the total amount of the order and the nature of the products ordered. They are communicated to the Client before the final validation of his order.

~ International shipping and delivery

~ Traitement des données personnelles et confidentielles
The informations that the Customer is required to provide are the informations necessary to handle his order. In conformity with the Informatique et Liberté French law from January 6th,1978, the customer has the right to access and correct the data that concerns him, simply by contacting Celine Garnier (see "~Customer service")
Céline Garnier does not keep or retain in any way any information related to the Customer's credit card following his payment.

~ Warranty
The warranty offered by Celine Garnier consists solely of replacing non-conform products if the quantity of products received doesn't match the quantity of products ordered, or of replacing products aknowledged as presenting a hidden defect, or, to Celine Garnier's sole preference, to reimbursing the price billed to the Customer. Thus, La garantie de Céline Garnier consiste uniquement au remplacement des produits non-conformes quant à la quantité commandée ou reconnus affectés d’un vice caché ou, au seul choix de Céline Garnier, au remboursement du prix facturé,to the exclusion of any other form of claim, including when the product is judged defective or flawed. Celine Garnier's warranty may under no circumstances be invoked for any additional fee such as storage fees or shipping fees.
A fortiori, Céline Garnier shall not, in any case, be held responsible for any direct or indirect consequence that could be claimed by the client or by a customer of the Client. Any warranty is excluded for incidents after delivery of the goods caused by storage by the Client or by improper use by the Client. The Client can only return the products to Celine Garnier once the products concerned have been cross-examined and once Celine Garnier gives her explicit agreement, in writing. Return shippintg costs shall be borne solely by the Client.
Each and any of the technical specifications provided are only indicative for best using conditions, but Celine Garnier cannot be held responsible for any improper use of the product by the Customer, nor for any consequence such improper use may have. The user is solely responsible to ensure the product is adapted to the work he plans to use Celine Garnier's products for . Celine Garnier retains the right to modify the characteristics of any product and of it's presnetation without notice, and'or to discontinue a product without notice.
To exert his rights, the Client must inform Celine Garnier in writing of the existence of those hidden flaws/defect, and shall do so within a maximum of 5 working days after discovery of the hidden deffect/flaw, under penalty of the Customer's rights regarding this deffective / flawed product being invalidated . The product aknowledged to be deffective / flawed shall be shipped back to Celine Garnier, in it's original packaging, within a maximum of 15 days following this notification.

~ Litigation management
Step 1. In case of a disppute related to a purchase on the wewsite celinegarnier-luthier.com, the Client may send a written complaint to the following address : Céline Garnier, 188 rue Siméon Freynet, 38350 Sievoz, France
Step 2. If the Customer is not satisfied by the response then received by customer services, or in case he does not receive any answer, he may refer to an Ombudsman.
The resolution proposed by the Ombudsman is not an obligation, each party stays free to refuse to discuss any further at any time.

~ Responsibility
Céline Garnier, in the process of online selling, has only a best-efforts obligation. The responsability of Celine Garnier may not be invoked regarding any damage resulting of the use of Internet such as, loss of data, intrusion, virus, loss of service, or any other involuntary problem.

~ Intellecutual property.Propriété intellectuelle
The rights of the texts, comments, illustrations and pictures reproduced on the website www.celinegarnier-luthier.com are reserved worldwide, and are under the protection of the author rights and intellectual property. Therefore, and in conformity with the disposition of the code of intellectual property, only private use is allowed, under condition to comply with each and any didposition of the code forementionned. Any reproduction, partial or globlal, of the website www.celinegarnier-luthier.com is prohibited.

~ Attribution of juridiction
The present General Terms and Conditions are subjected to the application of the French law. In case of a dispute, an amicable solution shall be sought beforehand. In case of any dispute related to the application of the present General Terms and Conditions, the French juridictions shall have exclusive competence.
The translation of this page to languages other than French are made only for the convenience of the Client. In the case of controversial interpretation only the French text is valid.
